Rewatching these but the scene was definitely rape. It wasn't forcible rape but the consent was given to Sam, not Tommy. It might translate differently to a man because with any vaginal sex, a woman is literally allowing someone else into their body. Let's say you're a straight guy... imagine that your girlfriend was really into anal play so you had finally consented to being blindfolded and pegged. Then you find out that your girlfriend wasn't actually there and it was actually your girlfriend's brother who put his penis inside you. Even if you enjoyed it at the time, that realization is heartbreaking. "To be fair to Tommy" is a "WTF?!" statement. Just because a woman is attractive does not give a man any claim to have sex with them.
