Seems like bullshit. You ever seen https://youtu.be/-4SuuIcDmug it is an intereting discussion on fair use from Pop Culture Detective channel with the New Media Rights legal advocates. Might be worth checking out since it's right up your alley but I'm sure you are pretty well versed in all this stuff by now anyway
