These orcs are the ones that survived but were too close to the bell when it rang to be able to run away. They are only figuratively dead, since Thess has chosen to spare them and give them another shot at life. As to the other part of your question, they aren't in the "Delve" which is the Dracomage's dungeon lair. He has the option of catching and rezzing the souls of those who died within the dungeon, bringing them to level 99, if he has some use for them. On the other hand, however, no one in the Delve has seen the Dracomage in a while...

For a story where one can actually end up on level 99 when one dies, this got me confused. Are they dead or not? Can one even die in the delve?
