You can use both. Just make sure to state which version you're using inside the Kinect TOP.

Does it matter which kinect is used? 360 vs xbox one?

This patch is prepared for real-time usage. If you're completely new to TD, I'd advice you to go through a couple of tutorials on how different types of nodes behave, before delving into more advance project usage. I'm going to try to make some time to make a brief 'readme' file, though.
