How to Avoid the Legal Pitfalls of a Transferrable H&K Auto Sear (Ad-free)
🕑 Added 2024-04-29 12:00:05 +0000 UTCOne of the particularly popular transferrable machine guns out there is the H&K auto sear. Since H&K grip and trigger assemblies are interchangeable between 9mm, 5.56mm, and 7.62x51mm guns (ie, MP5, HK33, and G3) a single registered full-auto grip assembly can allow someone to effectively have three machine guns for the price of one (albeit only one at a time). However, there are some potentially very expensive and dangerous pitfalls for someone acquiring one of these without a full understanding of the law and the technical details.
In short, an H&K upper receiver that has the ability to fit a factory full-auto grip assembly is considered a machine gun by ATF, just like an AR lower with the third pin hole drilled. If you have a registered standard factory full-auto grip, any gun it can attach to is also by definition a machine gun. Instead, the proper way to do this is to register a grip assembly that is modified to fit onto factory semiauto receivers. This sounds pedantic and strange - and it is - but it is a complex and tricky area of law and ATF rule making. If you are planning to put tens of thousands of dollars into a transferrable H&K, you really ought to have a clear understanding of these issues before you make a purchase!

legally a m16 lower is the machinegun. ok. where does the fullauto bolt carrier is in that definition? is that a free to purchase part stateside?

you kind of watch too many, even if kult, movies in times. hohoho..... jokes aside: the 5 ok. if one doesn't have a 53/33 by chance.... who really wants a funswitch g3? unless you want to get rid of a loose tooth or so. there is a reason why brits issued fals only in semi... doable on full yeah... but how.

Okay, I'm not even in the right country to have much use of this, but it was a very interesting video! It does very much highlight the bureaucratic idiosyncrasies of American firearms legislation. Like, dear gods above, I feel for you that you have to keep track of this stuff, even though you're very luckily in being allowed to have machineguns at all...

In the 80s when the ATF and media were hyping the assault weapons are easy to convert to machine guns mantra - The ATF in all its wisdom decided that some conversion parts were also tantamount to machine guns. (e.g. drop in auto sears) Then - In the run-up to the 86 ban, clever SOT manufacturers, etc said great, this part (e.g. Uzi bolt, HK sear, is a "machine gun" I want to register it which the NFA branch at the time would allow - so we have these parts like an Uzi bolt or HK lower you can own as surplus parts or as a machine-gun - just seems inconsistent.
