If I remember correctly, the character was originally created by Neil Gaiman for the SPAWN title which was owned by McFarlane. I think McFarlane tried to take control/credit for that and other Gaiman-created characters like Angela and Gaiman took him to court over it. I'm not super familiar with the case, mostly reading about it in a book about the absolute rights nightmare that is Marvelman/Miracleman(The Poisoned Chalice.
