The ADA, having driven separately, was climbing out of her own car and Mr. Stackhouse, a partner apparently, was already walking over to her. “Michelle,” he said cordially.
“Roger…,” she said, clearly surprised, “A little late for something like this, isn’t it?”
“Well you’ve arrested my client on a bigamy charge despite him being married only to one woman.”
“Are we really going to do this right here?” she said.
“You take him in for fingerprinting and I’ll call the judge right now. I’m sure he’ll be cranky at being woken up. Especially when he finds out why,” the man said smoothly.
Michelle sighed, and looked at me, “He told me he was married to this Kyrsten, woman. But his other wife was there with a ring and I checked, they got married in New York a few months ago. What’s the issue.”
The man opened his briefcase, making a loud click in the quiet, dark night. “This is a sworn affidavit from Miss Kyrsten Elias,” he said, heavily emphasizing the ‘Miss’, “It states that she is not now, nor has she ever been married. Neither to Mr. Simpson nor to anyone else.”
“I talked to the Sheriff. He’s our neighbor. He’s been introducing her as his fiancee.”
“I’m sorry,” Mr. Stackhouse said smugly, “Which Florida code codifies ‘intent to commit bigamy’ as a crime?”
She sighed, “You know as well as I do that the precedents support prosecutions for people that live as husband and wife even without a legal agreement.” She was clearly frustrated by this point.
“Yes, a 1955 precedent. Are you going to be relying upon it in court?”
The two stared at each other for a moment before she finally gestured to the two cops who were standing on either side of me, “Uncuff him… find… you’re not under arrest, Mr. Simpson,” she said. The cuffs were unlocked and I rubbed my wrists in relief. I thought that was just at thing people did in movies but I can tell you, it’s not. Sit with your hands bound by metal behind your back for 30 minutes in an uncomfortable police car and you’ll understand. “BUT,” the ADA continued, “I want to talk to your client.”
“I’m afraid…,” Roger started but she cut him off.
“I still have the warrant. I can still arrest him. I’ll take some heat but he’ll still have that arrest you’re desperately trying to avoid.”
Roger looked at me as if assessing me. The man was actually pretty imposing. He stood at least 6’4 or more with salt and pepper hair. The three of us walked silently into the precinct and back to a row of rooms in the back, “An interrogation room, Michelle? Really?”

It was like every exchange between the two of them had this undercurrent of competition between them. “Fine, goddamnit…,” she said and walked us over to a spare office. She yanked the door open, and ushered us in with a gesture so condescending that it practically oozed from her fingertips. “Sit down,” she said, following us inside. I looked at Roger who indicated a set of chairs in front of a spartan wooden desk. The cheap upholstery was uncomfortable but, so far, I’d managed to avoid a jail cell or even a metal chair in a bleak interrogation room. I could deal with a little frayed, green cloth on a chair that looked like it was purchased in the 70s.
“Okay… talk to me, Roger.”
“My client has committed no crimes…,” he started but Michelle cut him off with a wave of her hand.
“Has he been presenting Ms…, Elias? As his wife?”
“He’ll stipulate that he’s introduced her that way upon occasion.”
“Are they living together?”
“They are,” he said carefully. I could tell Roger was choosing his words very carefully.
“Cohabitating and passing off someone as a wife are the same prerequisites established by the 11th circuit and the Florida Supreme Court. I can give you the case citations if you’d like.”
“Gardner v Gardner and Smith v Townsend?” he asked, pulling two thin manilla folders out of his briefcase. He looked up at the ADA and I could see her smile falter slightly. She looked a little less predatory and intimidating than she had an hour earlier.
“Those are the two primary ones…”
“They’re the only ones and you know it. And they’re not exactly applicable you know. Smith had four wives that he’d legally married and the state was prosecuting the fifth one because she was the only one that would testify. They felt it was a lot easier and the court agreed. Gardner involved an underage girl that he’d taken advantage of and ‘married’ then kept her locked up in the house and took complete control of her money. Which he’d also done to the first wife who was testifying against him for a whole host of other things of which bigamy was the least of the concerns.”
Michelle folded her arms, “It’s still controlling precedent. Enough for me to book him and you’ll never get a prosecutorial abuse case to stick.”
The two attorney’s eyed each other but this time, it was Stackhouse that backed down. “My client is a good man with an unusual lifestyle. He’s not a monster which is what these statutes were attempting to stop.”
“How am I supposed to know that?”
He started to say something then he leaned over to me, “You’ve got nothing to hide, right?” he whispered.

He leaned back away and looked at Michelle again before pulling his briefcase back out. “Talk to them,” he said simply as he pulled out a pen and a legal pad.
She eyed the two of us, “You’ll let me talk to them?”
I looked at Roger and shrugged, it seemed like an idea with no real downside. I had a good relationship with all of them and I knew there wasn’t anything crazy to hide. “Sure… all four of them with or without me. Whatever you want… ma’am,” I said, trying to be respectful.
“Four?”
Stackhouse looked at me and shrugged as if to say, “You sort of gifted her that and we can’t walk it back now.”

She looked at me and made some notes then nodded and said, “That’ll be fine. I’ll be in touch to schedule the interviews. He doesn’t leave the state until I say so?” she said, turning back to my attorney.
“That’s fine,” he said. “And you’ll give me a heads up before any further arrests are made?”
She looked at him and then at me, “Unless I find something that makes me change my mind.”
“You won’t,” I said and she shot me a look filled with daggers.
“Then we’ll be going. Jay, your wife should be here shortly if she’s not already,” he said and he ushered me outside. As we got into the lobby he turned to me, “Okay… you did good in there. Probably only needed to give her Carly and Kyrsten but giving her all four of them shows some openness. Anything I need to know?”
We walked through the door outside and into the calm night. The slight breeze coming in off the ocean was a relaxing, familiar sound. “Are you romantically involved?”

A lot of your musings mirror my own when I was working through this story (particularly when it came to the second book which I didn't want to be "more of the same"... As I've been going about my day-to-day life for the last few days, I've been reflecting on one aspect of this chapter that I really appreciated. Specifically, I thought it made perfect sense that Jay and Carly didn't have a suitable criminal defense lawyer on tap, just ready to go. Instead (just like one might expect for someone in their financial position), they absolutely had tax and financial representation, and those professionals were able to recommend suitable counsel. I thought that detail made a lot of sense, and certainly rang true to life. As a side note, I also appreciated Jay's recognition of the fact that his money and the resulting power made the arrest considerably less of an inconvenience and threat that it might have otherwise been. Something else that I've been mulling over for a while now: In these sorts of stories, it is often beneficial for the characters to be independently wealthy so they can afford to have these extravagant fantasy lifestyles. In fact, it's almost REQUIRED that the characters in stories this extravagant have some sort of wealth, just so the story is possible. With that said, I really hate it when stories just throw in a brief statement that various characters are independently wealthy and as such they just get to do whatever the hell they want and have enormous wealth and power. That kind of bullshit makes me roll my eyes and really turns me off of an author's work. I think I would much rather not HAVE an explanation for how characters can afford to do thing A or thing B then to have a terrible explanation like that. I think that the way you've gradually introduced Jay and Carly's wealth and power into the story helped preserve my suspension of disbelief. Discussion of their financial means made it into the story as it made sense to do so, in bits and pieces. A statement on ethics: I appreciated the occasional acknowledgment of the privilege afforded to the story participants because of their wealth and power. I also approved of the various limits that those with power imposed upon themselves, for the betterment of those less fortunate around them. Specifically, I very much appreciate that Jay is requiring that the women in his life who are going to college must complete that schooling (and presumably, earn good grades while they're at it). Additionally, despite her preferred status as absolute bottom feeder, Jay refused to take control of Carly's wealth. All of these actions serve to preserve the real life interests of the people around Jay, with a mind towards leaving them the option to stop being under his power whenever they wish to do so.

Interestingly, I did some googling and it appears that in the past utah maintained statutes allowing common law marriage partially to enable polygamy prosecution of individuals who merely said they were married without actually filing the relevant papers (statutory marriage). Apparently one key component of a common law marriage is the couple having proclaimed themselves to be husband and wife, and being known to their community as being married. In other words, some variants of common law marriage statutes might have considered Kyrsten and Jay to be married. Fortunately, it doesn't appear that merely cohabitating without adopting the terms and trappings of marriage will usually invoke common law marriage, in the few states that still recognize such. I had briefly pictured a hellish world where merely living with multiple partners would be illegal because the state could always argue that the participants were common law married, without any of those persons having deliberately sought statutory marriage status.
I'm really glad that was your reaction. I know these last couple chapters have been sex light but there were just so many story elements I was trying to bring in that I couldn't find any way around that. The next couple chapters will be a little more smut filled (I know you weren't complaining btw...) The legal stuff: Yes, I did some research and some poking around. The cases are completely fictitious but hopefully sound sufficiently real that it doesn't break anyone's immersion. One of my big pet peeves is reading stories about poker where the writer clearly doesn't understand how poker works. The biggest one being when someone bets more than the other person has to cover and somehow the writer thinks that means the better "wins the pot" unless the other person comes up with the difference. It just completely ruins those stories for me. So I try to make sure I'm sufficiently educated on something before I write about it so I don't ruin the experience for others ;)
You know, for a story series I started reading because of the sex, this started off with absolutely none ... and I was still eager to dig into it. You've created a great "universe" for this whole fantasy to play out inside. And did you do your research here? Because the legal stuff was very convincing! Honestly, I think Hideo likes the lifestyle they have now. Sherry seems to genuinely care for him outside of a sexual role, and Hideo fully knew what he was getting with Sherry and actively stays with her. Arguably, there is likely a subconscious element from Hideo's part as to why Aimee is there too, based on Aimee's choice of words and correcting herself before she said too much.
