I defended mortgage foreclosure during HAMP. If every foreclosure defendant had a lawyer, it would have been very difficult for the foreclosures to succeed, because the plaintiffs (banks, servicers, etc.) broke so many rules. Unfortunately, these defendants, overwhelmingly poor, did not have the means to hire a legal defense. Foreclosure mills filed complaints by the hundreds and only a relative handful of legal aid and pro bono attorneys were available to fight them.
