“Oh right, you have the right to REMAIN an attorney.” “Did you say you have the right to be an attorney?” 🤣 At least your version was more accurate. The reason why they are called Miranda Rights is because in 1963, a man called Ernesto Miranda who was accused of SA’ing and kidnapping a woman was interrogated by police for several hours and confessed to the crimes he was accused of which was used against him in his jury trial. However, the Supreme Court in a closed decision held that his confession shouldn’t have been used against him because it was unconstitutional to not inform him he had the right to remain silent and that he had a right to have a lawyer present during questioning which is why they do this today.
