I'm watching this for the first time with you guys! I'm understanding the can/cannot thing as whatever his position is, he's here to test the rear palace's loyalty to the emperor right? So, whether or not he would WANT to give the order to execute her or anyone who was disloyal, the fact that he CAN and he would probably have to against his wishes means that she could never let her guard down with him. He will always unfortunately be in a position that she needs to honeslty be scared of.

One thing I want to point out is that Jinshi is much more calculating than he looks as maomao has pointed out when she can't exactly get a pin on what he's really like. He's not naive but he does have a cloth in front of his face when it comes to maomao because she's someone he's interested in.
